1. Acceptance of Terms

By accessing or using AutoRooster, you agree to be bound by these Terms of Service. If you do not agree, please do not use the service.

2. Description of Service

AutoRooster is an automotive research and community platform that provides vehicle specifications, search tools, comparison features, dealer listings, and community engagement features. We aggregate publicly available vehicle data for informational purposes.

3. User Accounts

• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 16 years old to create an account.
• We reserve the right to suspend or terminate accounts that violate these terms.

4. User Content

By posting content (reviews, community posts, photos, MPG logs), you:

• Retain ownership of your content.
• Grant AutoRooster a non-exclusive, royalty-free license to display your content on the platform.
• Agree not to post content that is illegal, defamatory, harassing, or infringes on others' rights.
• Acknowledge that community posts (Showroom, Peck My Ride, etc.) are visible to all users.

5. Dealer Accounts & Obligations

• Dealer accounts require approval by AutoRooster administration. Dealers must provide a valid state dealer license number, EIN, and accurate business information during registration.
• Dealers are solely responsible for the accuracy of all vehicle listings, including but not limited to: price, mileage, condition, title status (clean, salvage, rebuilt, flood), VIN, and vehicle history.
• Dealers must comply with all applicable federal and state laws, including the FTC Used Car Rule (Buyers Guide), FTC Safeguards Rule, state dealer licensing requirements, and NMVTIS reporting obligations.
• Listing fees are $5.99 per vehicle listing. Fees are non-refundable once a listing is published.
• AutoRooster reserves the right to suspend or terminate dealer accounts for inaccurate listings, fraudulent activity, expired dealer licenses, or violations of these terms.
• AutoRooster may verify dealer credentials, including state dealer license and EIN, at any time. Failure to provide valid documentation upon request may result in account suspension.

6. Vehicle Listings & Buyer Disclaimer

AutoRooster is a marketplace platform that connects buyers with licensed dealers. AutoRooster does not own, inspect, verify, or guarantee any vehicle listed on the platform.

• Vehicle history, condition, mileage, and title status are the sole responsibility of the selling dealer.
• Buyers are strongly encouraged to request a vehicle history report (e.g., Carfax, AutoCheck) and conduct an independent pre-purchase inspection before completing any transaction.
• AutoRooster is not a party to any transaction between buyers and dealers and assumes no liability for disputes, misrepresentations, or vehicle defects.
• OEM specification data (horsepower, MPG, dimensions, etc.) is sourced from publicly available manufacturer information and is provided for reference only. Always verify with the manufacturer or dealer.

7. Prohibited Conduct

You agree not to:

• Scrape, crawl, or automatically collect data from the platform without permission.
• Attempt to gain unauthorized access to any part of the service.
• Use the platform for spam, fraud, or misleading purposes.
• Interfere with the operation or security of the service.

8. Limitation of Liability

AutoRooster is provided "as is" without warranties of any kind, express or implied. We are not liable for any direct, indirect, incidental, or consequential damages arising from:

• Vehicle purchasing decisions made based on information found on the platform.
• Inaccurate, incomplete, or misleading information provided by dealers or users.
• Any transaction, dispute, or interaction between buyers and dealers facilitated through the platform.
• Loss of data, unauthorized access, or service interruptions.

AutoRooster's total liability shall not exceed the amount you have paid to AutoRooster in the twelve (12) months preceding the claim.

9. Changes to Terms

We may modify these terms at any time. Continued use of the service after changes constitutes acceptance of the updated terms.
